Business Development Incentives Screening Form

  1. If you are seeking Industrial Revenue Bond (IRB) or Local Economic Development Act (LEDA) Incentives for a qualified development in the Village of Los Lunas, you must complete this screening form so that we may begin to assess your request. Once you have submitted this form, someone will contact you within five (5) business days about your request.

  3. Is your proposed project located in an underserved area of the Village?*
  4. Does your proposed project increase economic development impact by creating wealth and capital investment, increasing wages and creating jobs, positively influencing and supporting the community, producing environmentally sustainable outcomes, increasing health and/or safety of the community, and increasing the diversity of the local economy? *
  5. Provide a one-page description/summary of the proposed project. Include all relevant information to the project including, but not limited to: zoning, square footage of facility, neighborhood and environmental impacts and infrastructure needs. You may enter the description in the form or attach a separate document.

  10. LEDA Qualifying Entity

    “Qualifying entity" means a corporation, limited liability company, partnership, joint venture, syndicate, association or other person that is one or a combination of two or more of the following:

    1. an industry for the manufacturing, processing or assembling of agricultural or manufactured products;
    2. a commercial enterprise for storing, warehousing, distributing or selling products of agriculture, mining or industry, but, other than as provided in Paragraph (5), (6) or (9) of this subsection, not including any enterprise for sale of goods or commodities at retail or for distribution to the public of electricity, gas, water or telephone or other services commonly classified as public utilities;
    3. a business, including a restaurant or lodging establishment, in which all or part of the activities of the business involves the supplying of services to the general public or to governmental agencies or to a specific industry or customer, but, other than as provided in Paragraph (5) or (9) of this subsection, not including businesses primarily engaged in the sale of goods or commodities at retail;
    4. an Indian nation, tribe or pueblo or a federally chartered tribal corporation;
    5. a telecommunications sales enterprise that makes the majority of its sales to persons outside New Mexico;
    6. a facility for the direct sales by growers of agricultural products, commonly known as farmers' markets;
    7. a business that is the developer of a metropolitan redevelopment project;
    8. a cultural facility; and
    9. a retail business;
  11. If you are seeking IRB, do you meet the definition of a qualifying project in the NM Municipal Industrial Revenue Bond Act NMSA 3-32-1 (B)?*

  12. IRB Qualifying Project

    "Project" means any land and building or other improvements thereon, the acquisition by or for a New Mexico corporation of the assets or stock of an existing business or corporation located outside the state to be relocated within or near the municipality in the state and all real and personal properties deemed necessary in connection therewith, whether or not now in existence, which shall be suitable for use by the following or by any combination of two or more thereof:

    (1) an industry for the manufacturing, processing or assembling of agricultural or manufactured products;

    (2) a commercial enterprise in storing, warehousing, distributing or selling products of agriculture, mining or industry but does not include a facility designed for the sale of goods or commodities at retail or distribution to the public of electricity, gas, water or telephone or other services commonly classified as public utilities;

    (3) a business in which all or part of the activities of the business involve the supplying of services to the general public or to governmental agencies or to a specific industry or customer but does not include an establishment primarily engaged in the sale of goods or commodities at retail;

    (4) a water distribution or irrigation system, including without limitation, pumps, distribution lines, transmission lines, towers, dams and similar facilities and equipment, designed to provide water to a vineyard or winery;

    (5) an electric generation or transmission facility, other than one for which both location approval and a certificate of convenience and necessity are required prior to commencing construction or operation of the facility, pursuant to the Public Utility Act [Chapter 62, Articles 1 to 13 NMSA 1978];

    (6) an energy storage facility, which is a facility that uses mechanical, chemical, thermal, kinetic or other processes to store energy for release at a later time to integrate energy supply associated with renewable generation across the electric grid; and

    (7) a 501(c)(3) corporation;
